These General Terms of Use (GTU) aim to define the terms of use of the site iacrea.com and the IACrea mobile applications (iOS and Android) (hereinafter "the Site"), owned by the company IACrea SAS (hereinafter "the Seller"), whose registered office is located at 60 RUE FRANCOIS IER, 75008 PARIS, France, along with its associated services. By accessing the Site or using its services, you unconditionally accept these GTU. If you do not accept these terms, you must cease all usage immediately.
The site iacrea.com and the IACrea mobile applications (iOS and Android) (hereinafter referred to as the "Services") allow the User to access a range of features for creating and sharing real estate content using artificial intelligence technologies. Access to the Services requires the creation of a personal account and the subscription to an active plan. The subscription grants access to all available features, including: - Photo retouching and enhancement using artificial intelligence; - Transformation of photos into videos (photo animation); - Creation of video montages; - Scheduling and publishing content on social media; - Access to mobile applications (iOS and Android) that enable photo capture and enhancement; - The paid option "2D Plans," allowing the scanning of rooms to obtain 2D plans (subject to technical conditions and limitations described in Article 8 bis, particularly the availability exclusively on iPhone Pro devices equipped with LiDAR). Each subscription includes: - A defined number of credits allowing the use of certain features (notably photo animation into video and some AI processing); - A defined number of mobile licenses allowing the use of the mobile application and the capture of enhanced photos. The features are accessible only during the duration of the active subscription.
When accessing the website, the user agrees to: - Be of legal age and have full legal capacity. - Provide accurate registration information and update it in case of changes. - Use the website in accordance with applicable laws and regulations. - Not create multiple accounts for fraudulent purposes. - Verify the legality and compliance of the submitted and generated images, especially for commercial use.
The User agrees not to: - Use automated means (robots, scripts, etc.) to interact with the Site. - Bypass security measures or access unauthorized data. - Use the Site for illegal, defamatory, or fraudulent purposes. - Share or resell their subscription without authorization. - Reproduce, copy, or redistribute the Site’s content without written permission from IACrea SAS (contact@iacrea.com). - Edit with AI any photos that allow identification of physical persons.
The user is solely responsible for the images they submit and the generated content. They undertake not to infringe upon the copyrights, image rights, or trademarks of third parties. IACrea cannot be held liable for the use of the generated content, including in cases of commercial or public distribution.
The content of the website (source codes, texts, graphics, videos, trademarks, etc.) is the exclusive property of IACrea SAS. Any reproduction or use without written permission is prohibited. The images and videos created by the user on the website belong exclusively to them. They guarantee that they have the necessary rights to the files submitted. The submitted and generated images may be used by IACrea to improve its AI models, unless the user objects in writing. The user undertakes to refrain from the following: - Using the generated content to train other AI systems. - Attempting to access, copy, or alter IACrea’s algorithms. - Compromising the security or integrity of the system.
Access to the services is subject to the subscription of an active plan. During the subscription period: - The User can publish an unlimited number of contents on social media through the platform, - The User can create an unlimited number of video edits, - The animation of photos into videos using artificial intelligence consumes credits. Mobile licenses: Each subscription includes a defined number of licenses allowing the use of the IACrea mobile application. A license corresponds to an authorized user able to capture photographs through the application. Enhanced photographs: Each subscription includes a defined number of photographs that can be captured and enhanced via the mobile application. Each capture and processing counts as one unit consumed. Beyond the included quantities, additional credits can be purchased. Data synchronization: Photographs taken through the mobile application are automatically synchronized with the User's account and stored on IACrea's servers to allow for processing and access from the Site. Content accessibility duration: Contents (photos, videos, projects) are accessible for a duration of 10 months as long as the subscription is active. In case of termination, the contents remain accessible for 1 month, after which they may be permanently deleted. These provisions also apply to photographs captured through the mobile application.
The automated ad campaigns module allows the User to create and run ad campaigns on Meta (Facebook, Instagram) to promote real estate properties. Ads are run from a Facebook page owned by IACrea SAS. This module provides a tool for advertising on Meta, which may (but is not guaranteed to) generate seller and buyer leads. No guarantee of lead generation is offered. By using this module, the User expressly represents and warrants: - That they own the photos and content used for the ad campaigns, or hold all rights necessary to use them for this purpose. - That they hold a valid, active mandate for the property being advertised. - That they agree that IACrea SAS may run ads for the property on social networks, including Meta (Facebook, Instagram), from its own page. - That they agree that IACrea SAS may receive and forward to them the contact details of people interested in the property who have expressed their interest via the ads, if such contacts are generated. The User acknowledges that each ad campaign consumes a certain number of credits, which varies according to the selected parameters (budget, duration, targeting, etc.). Credits are deducted at the time the campaign is created. The User is solely responsible for ensuring that the advertising content complies with applicable law, including real estate advertising, personal data protection, and third-party rights. IACrea cannot be held liable for any consequences related to the use of the transmitted contact details or the distribution of the ads.
The IACrea mobile app lets you capture photos on a mobile device and enhance them using artificial intelligence technologies. The User acknowledges that: - the generated images may differ from reality (brightness, colors, proportions, visual elements), - these modifications are intended to improve visual presentation and do not guarantee an accurate representation of the property, - it is the User’s responsibility to ensure that images used in a commercial context are not misleading or likely to mislead. The User is solely responsible for the use of images in the marketing of a property, particularly with respect to legal obligations regarding non-misleading advertising.
The paid option “2D Plans” can be subscribed to in addition to the subscription. It allows the User to scan rooms via the IACrea mobile application to obtain 2D plans. **Technical access conditions:** The scan plan creation feature is only accessible on iPhone Pro devices equipped with LiDAR technology. It is not available on the Android application or on other iOS devices that lack LiDAR. The User acknowledges that the absence of a compatible device may prevent the use of this feature. **Nature of the service:** The “2D Plans” service provides assistance for the quick creation of plans. It does not replace a professional survey, certified measurement, or any document with regulatory value or enforceability. **No guarantee of accuracy:** IACrea does not guarantee the accuracy, precision, completeness, or compliance of plans obtained through scanning (surfaces, dimensions, proportions, room layouts, or any other elements). The User remains solely responsible for verifying and using the generated plans, particularly in a commercial, advertising, or contractual context. **Limitation of liability:** IACrea cannot be held responsible for inaccuracies, errors, omissions, or approximations present in a scanned plan, nor for any direct or indirect consequences that may arise from them. **Modification from the Website:** The User can modify the information on the plan (including surfaces, labels, or displayed elements) from the Website (web interface) to adapt it to their needs. It is their responsibility to check the final result before any distribution or use.
A free trial may be offered to any new user with a valid professional email address. IACrea reserves the right to deny this trial in the case of temporary email addresses, multiple usage, or suspicious behavior.
Use of photographs and artificial intelligence: The IACrea mobile application allows for the capture of photographs as well as their automatic enhancement through artificial intelligence technologies, including HDR processing. The User acknowledges that: - The generated images may differ from reality (brightness, colors, contrast, overall rendering), - These enhancements aim to visually highlight the properties without guaranteeing a perfectly accurate representation, - It is their responsibility to ensure that the images used in a commercial context are not misleading or likely to cause confusion. The User is solely responsible for the use of the images, particularly in the context of promoting or selling real estate, and for complying with applicable advertising regulations.
IACrea's services are based on artificial intelligence models. The generated results may vary and are not guaranteed. The User acknowledges that the renderings may differ from their expectations and that no guarantee of result is offered. No refunds are granted for results deemed unsatisfactory.
IACrea reserves the right to modify these Terms of Use at any time. Changes will take effect as soon as they are published on the Site. Continued use of the Site after the publication of the new Terms of Use constitutes acceptance of these modifications.
IACrea strives to ensure the availability and reliability of the Site, but cannot guarantee the absence of errors, interruptions, or failures. In no event shall IACrea be held responsible for direct or indirect damages resulting from the use of the Site or the generated content, including in the case of data loss, profits, or operations.
The personal data collected is processed in accordance with the Site's Privacy Policy. It is used solely for account management, billing, and service improvement. The User has the right to access, rectify, and delete their data. Photographs taken via the mobile application may be automatically synchronized with IACrea's servers to allow for processing and storage.
These Terms of Use are governed by French law. Any dispute will be submitted to the competent courts of the jurisdiction where IACrea SAS is headquartered, unless a mandatory legal provision states otherwise. In accordance with Articles L.611-1 and following of the French Consumer Code, any User who qualifies as a consumer may access the mediation service designated by IACrea SAS for free: the Consumer Mediation Center of Justice Conciliators (CM2C), after a prior written complaint to IACrea SAS (contact@iacrea.com) that remains unanswered. Some features of IACrea allow you to publish and manage content on YouTube through the YouTube API Services.
