The present General Terms and Conditions of Sale (GTCS) govern the contractual relationships between the company IACrea SAS (hereinafter referred to as "the Seller") operating the website iacrea.com and the IACrea mobile applications (iOS and Android) (hereinafter referred to as "the Site") and any natural or legal person wishing to purchase services or products offered on the Site (hereinafter referred to as "the Client"). The GTCS define the conditions under which the Client can subscribe to a membership and purchase credits to generate photos, videos, or plan content via the Site. Any order implies unconditional acceptance of these GTCS.
The Seller offers a platform accessible through the website iacrea.com and the IACrea mobile applications (iOS and Android), allowing the creation of real estate content using artificial intelligence technologies. The services include, in particular: - Enhancement and retouching of photographs, - Transformation of photos into videos, - Creation of video montages, - Publication and scheduling of content on social media, - Capture and enhancement of photographs via mobile applications, - The paid option "2D Plans," which allows for room scanning to obtain 2D plans (subject to technical conditions and limitations described in Article 16, notably availability exclusively on LiDAR-equipped iPhone Pro). Services are accessible as part of a subscription. Each subscription includes: - A defined number of credits, - A defined number of mobile licenses, - A defined number of enhanced photographs via the mobile application, - Unlimited access to social media publication, - Unlimited creation of video montages. Definition of "enhanced photographs": An enhanced photograph corresponds to an image captured via the mobile application or imported to the Site, then processed using the Seller's artificial intelligence technologies to improve its visual rendering. Each processing consumes one unit included in the subscription or billed additionally. Some features, notably animating photos into videos, consume credits.
All prices are exclusive of taxes. Applicable taxes will be added to the final price during checkout according to current legislation. The seller reserves the right to change prices at any time, but services will be billed based on the rate in effect at the time of ordering or subscription renewal. Any price change will be communicated to the customer before the next renewal of the subscription.
The order is placed directly online on the website after creating an account. The customer undertakes to provide accurate and up-to-date information. By confirming their order, they accept all of these terms and conditions. Every order is final and cannot be canceled unless otherwise provided by law.
Payment is required at the time of order and is made online using the methods offered by the Seller, including credit card via Stripe. Subscriptions are billed on a recurring basis (monthly or annually) until cancelled. Additional credits can be purchased at any time from the Site. Subscriptions and credit purchases are made exclusively through the site iacrea.com. No purchases can be made directly from the mobile applications. The mobile applications only provide access to the subscribed services and do not constitute a billing channel. The Client is responsible for keeping their payment information up to date. In the event of a payment failure, access to the services may be suspended until the issue is resolved.
Services are activated immediately upon payment confirmation. The credits included in the subscription allow access to certain specific features. They are valid only for the duration of the active subscription. Carrying over unused credits: As long as the Client's subscription remains active, unused credits (excluding enhanced photographs from the mobile app) are carried over from one billing period to the next. The carried-over credits are valid for six (6) months from their allocation. The carryover is capped at three (3) times the number of credits subscribed to under the current subscription. In the absence of an active subscription, no carryover is made: unused credits are reset to zero and do not qualify for any refund. HDR photographs (enhanced photographs) included via the mobile app are not subject to carryover: unused units at the end of a billing period are lost. The following features are accessible unlimitedly during the subscription period: - The creation of video montages without AI, - Publishing content on social networks. Certain actions, including animating photos into videos or exceeding the included number of photographs, consume credits. In the event of cancellation, the Client retains access to their remaining credits until the end of the current billing cycle. On that date, all unused credits are reset to zero and do not qualify for any refund.
Subscriptions are monthly or annual based on the Client's choice, with automatic renewal, and can be canceled at any time from the Client's personal space. The cancellation takes effect at the end of the current billing cycle. No refunds are made for the started period. In the event of cancellation: - The Client retains access to their services and remaining credits until the end of the current billing cycle. - At the end of this cycle, all unused credits are reset to zero; no carryover is possible without an active subscription. - Access to features (scheduling, social media posting, templates, etc.) is interrupted at the end of the subscription period, and scheduled posts beyond this date will not be sent. - IACrea SAS reserves the right to delete projects and associated media linked to the Client's account 3 months after the subscription cancellation.
According to Article L221-28 of the French Consumer Code, the services offered are digital services that are provided immediately after payment. The customer expressly waives their right of withdrawal by activating their subscription or credits. No refunds will be given, even in the case of unsatisfactory results, errors generated by artificial intelligence, or interruption of service due to subscription cancellation. Consumed credits cannot be refunded or exchanged.
Artificial intelligence is based on probabilistic models, so results may vary. The Seller does not guarantee any specific outcome, as the quality of the renderings may differ depending on use cases, input data, and the models used. A high number of monthly credits is intentionally offered to allow for multiple attempts, but there is no guarantee of results and no refunds will be provided for unsatisfactory renderings. The Seller cannot be held responsible for how the Client uses the generated content, including for public, commercial, or promotional distribution. The Client is solely responsible for ensuring their content complies with applicable laws and regulations.
The content of the website (source codes, texts, graphics, videos, trademarks, etc.) is the exclusive property of IACrea SAS. Any unauthorized reproduction or distribution is prohibited. The images, videos, and content generated by the customer belong exclusively to them. The customer guarantees that they have the required rights to the files they provide and have obtained the necessary permissions for their use. The customer allows IACrea, non-exclusively and without compensation, to use the generated images and content for the purpose of improving its artificial intelligence models and services.
The seller cannot be held liable for direct or indirect damages related to the use of the website or services. The customer is solely responsible for the images and videos they create and their use, particularly with regard to copyrights, trademarks, or personal rights. The results generated by artificial intelligence may vary, and the seller provides no guarantee that they will meet the customer’s expectations.
The personal data collected is processed in accordance with the website's privacy policy, which is accessible at any time. This data is used exclusively for account management, billing, and the improvement of the service.
These General Terms and Conditions are governed by French law. In the event of a dispute, the parties will strive to find an amicable solution. Failing that, the competent courts will be those within the jurisdiction of the registered office of IACrea SAS, unless there is a mandatory legal provision to the contrary. Consumer mediation: In accordance with Articles L.611-1 and following and L.616-1 of the Consumer Code, any Client who qualifies as a consumer has the right to use a consumer mediator free of charge for the amicable resolution of the dispute with the Seller. To this end, the Seller has designated the Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C). After a prior written complaint to IACrea SAS (contact@iacrea.com) that has gone unanswered or unresolved in a reasonable time, the consumer Client can contact the mediator: - online: https://www.cm2c.net/ - by mail: CM2C, 49 rue de Ponthieu, 75008 Paris - by e-mail: declarer-un-litige@cm2c.net Mediation is free for the consumer. The language used is French. These provisions apply exclusively to consumer Clients as defined by the preliminary article of the Consumer Code. Professional Clients are not eligible.

The automated advertising campaign feature allows the Client to create advertising campaigns on Meta (Facebook, Instagram) to promote real estate properties. Ads are displayed from a Facebook page owned by IACrea SAS. This feature implements a tool for advertising on Meta, which may (but does not guarantee) generate seller and buyer leads. No guarantee of lead generation is provided. **Client Commitments:** By using this feature, the Client expressly declares and guarantees: - To be the owner of the photos and content used for the advertising campaigns, or to possess all necessary rights for their use in this context. - To hold a valid and current mandate for the real estate property involved in the advertising campaign. - To accept that IACrea SAS will publish ads for the property concerned on social media, including Meta (Facebook, Instagram), from its own page. - To accept that IACrea SAS will receive and pass on the contacts of individuals interested in the property who have expressed interest through the ads, if such contacts are generated. **Cost and Credit Consumption:** Each advertising campaign consumes a certain number of credits, varying according to the parameters chosen by the Client (advertising budget, campaign duration, geographic targeting, etc.). The number of credits required is indicated to the Client before the campaign is validated. Credits are debited immediately at the time of creating and launching the campaign. **Contact Transmission:** If contacts are generated through the advertising campaigns, IACrea SAS commits to passing on to the Client, in a timely manner, the contact details of individuals who have expressed interest in the property via the ads. The Client is solely responsible for the use of these contact details and must comply with applicable regulations regarding commercial prospecting, including GDPR and the confidence in the digital economy law. **Liability:** The Client is solely responsible for ensuring that advertising content complies with current legislation, particularly regarding real estate advertising, personal data protection, and respect for third-party rights. IACrea cannot be held responsible for the consequences related to the use of the transmitted contact details, the dissemination of the ads, or the results obtained (number of contacts, quality of contacts, etc.). No guarantee of results is provided regarding the effectiveness of advertising campaigns or lead generation. **Termination:** In the event of subscription termination, ongoing campaigns may be interrupted at the end of the billing cycle. Credits already consumed are non-refundable.
The paid option "2D Plans" can be purchased in addition to the subscription. It allows the customer to scan rooms using the IACrea mobile application to create 2D plans. **Technical Access Conditions:** The plan creation feature through scanning is exclusively accessible on iPhone Pro devices with LiDAR technology. It is not available in the Android application or on other iOS devices without LiDAR. The customer acknowledges that the absence of a compatible device may prevent the use of this feature, without any right to a refund for the option or subscription. **Type of Service:** The "2D Plans" service is a tool for quickly creating plans. It does not replace a professional survey, certified measurement, or any document with legal or binding significance. **Lack of Accuracy Guarantee:** IACrea does not guarantee the accuracy, precision, completeness, or conformity of plans obtained through scanning (areas, dimensions, proportions, room arrangements, or other elements). The customer is solely responsible for verifying and utilizing the generated plans, particularly in commercial, promotional, or contractual contexts. **Limitation of Liability:** IACrea cannot be held liable for inaccuracies, errors, omissions, or approximations in a plan derived from the scan, as well as for any direct or indirect consequences that may result from this. **Modifications via the Website:** The customer can change the information of the plan (especially areas, labels, or displayed elements) through the website (web interface) to adapt it to their needs. It is their responsibility to verify the final result before any distribution or use.
